    You quote from IEEE 802.11 7.3.2.13 ERP Information element. Assuming your lab observation of Cisco gear is accurate, I imagine that Cisco could have chosen to improve upon the standard on this detail.

    We are dealing here with compatibility issues across three generations of 2.4 GHz WLAN PHYs -- DSSS, HR/DSSS, and ERP. DSSS STAs that only support long preamble are few and far between. The same might be said of HR/DSSS if any HR/DSSS STAs were ever built that only support long preamble. Cisco may have implemented its own ERP wait and see policy that only forces the whole BSS to use long preambles after long preamble based retransmissions rise above some threshold. If they did they won't tell us, and neither the IEEE nor the Wi-Fi Alliance will care.
